Both of these men have done one thing right: they were honest. They didn't lie about what was obvious in the photos. They seem to be getting some forgiveness because of that, at least from the public.

I see my current and former students publishing silly photographs every day, usually on facebook. Often they have a laugh on Monday morning when publishing photos of themselves or their friends from Saturday night's party. "OMG, I can't believe it -- you were sooooooo wasted."
Be careful, it might be funny now, but it won't be so funny in five years when you're trying to get into medical school, or trying to get your teacher's license, or if you're running for office!
And you better believe it: the universities you apply to, or the employers you interview with, are checking you out on facebook and wherever they can find you on the web. Why wouldn't they? They will get a more accurate picture of you than those lying reference letters: "Frank is brilliant; one of the best students I have ever taught in my career . . . " Yeah, right!
Still, that redneck South Carolina sheriff can't throw Michael Phelps in jail for the photograph, right? Or, can he?
